This panel will touch upon the best practices that a motor carrier can use in its daily operations, in its record retention, in its handling of electronic and technological data, and in its claim resolution and investigation processes, to smite Reptilian tactics prior to litigation and, in an overall fashion, to prevent these tactics from even being used at all. The panel will also discuss how to push out these best practices, and positive, operational attributes, to create a mother lode of “good press” to be used before and during litigation. The panel will also summarize the various state legislative developments, from across the country, that are helping to begin to lower the inflammatory temperatures of nuclear verdict casualty litigation.
