There are deep changes at work in the way that issues of federal law are decided. For instance, last year the Supreme Court overruled the famous Chevron Doctrine regarding deference to federal agency interpretation of federal statutes. This has been commented upon frequently as a "conservative" move. Yet, the Chevron Doctrine arose originally as a mechanism to uphold less restrictive clean air mandates imposed the Reagan era EPA. Similarly, corporate rights under the Due Process Clauses of the Constitution are frequently important when corporations challenge the jurisdiction of inconvenient venues or excessive damages. Yet, the due process origins of some rights have recently been questioned by conservative judges. This talk will discuss whether there are hidden uncertainties and challenges for trucking companies beneath common assumptions about recent changes.
